Preservation failures turn manageable disputes into sanctions.

The hold letter is the easy part. What causes problems is everything after it: custodians who never acknowledged, systems nobody thought to suspend, automatic deletion that kept running, and a retention schedule that conflicts with the preservation obligation nobody reconciled it against.

It is included here because it is the obligation most often discovered late, and because the cost of getting it wrong is asymmetric — a preservation failure can matter more than the underlying dispute.
